Application to the Ministry of Industry, Trade and Labour
In an application letter addressed to Ms. Efrat Gur, in charge of licensing manpower agencies at the Ministry of Industry, Trade and Labour, WAC has demanded that Brick's license be revoked.
The application sheds light on alleged violations of various labour laws, justifying the annulment of Brick's license. The information contained therein was received from dozens of excavators at excavation sites of the Antiquities Authority, employed by Brick throughout the country.
According to the stipulations set by the Law on Manpower Agencies, an agency's license can be revoked following violation of substantial legal obligation(s) as set by law, collective work agreements or any other work contract. Prior notice, for that matter, is to be given by the minister of industry, trade and labour.
The struggle of Brick workers for the provision of their full legal rights, and for the implementation of the law to the letter, is of paramount importance. Given that the Authority is a government body with a scientific and cultural mission
statement, it is obliged to ensure that the workers it employs receive their full legal rights.
The violations mentioned in the application are as follows:
1. Salary deductions under the term of membership fees, which in effect were not transferred to their intended beneficiary.
2. Failure to provide notice on work conditions as set by the Law on Work Conditions (2002).
3.Failure to provide pension plan.
4.Violation of the Amendment to the Law on Manpower Agencies A12, stipulating that manpower employees become fully-fledged workers of the employer in effect after a 9-month term.
